$129000 verdict against judge overturned

...Judge Tapscott settled the case for about $2.5 million in 1999.At issue in the breach-of-trust case was whether Judge Tapscott knew that one of the companies, Pittsburgh Corning, had withdrawn its settlement offer when he told the family that the entire case had been settled.The family alleged that the misinformation shorted them $225,000 because the trial was delayed and Pittsburgh Corning filed for bankruptcy.Judge Tapscott said he honestly believed a settlement had been reached.

He added that the Jacobs family received a great settlement for a weak case because Mr.

Jacobs had a history of smoking."I feel vindicated today," he said.

"This case was frustration on their part that they didn't get everything that they settled for." Judge Tapscott added that the order had inspired him about the role of judges in the justice system."Occasionally juries do make mistakes, and that's why it's so important that we have good judges," he said.
