The Hilditch family are claiming damages between £50,000 and £100,000 from the company, now called Marconi Mobile Systems.

Mr Hilditch’s 47-year-old son Mark played 242 games for Rochdale FC in his two spells at Spotland.

He is now a prison officer at Buckley Hall and a coach at Oldham Athletic’s youth academy.

He said: "More and more people are becoming aware of the dangers of asbestos, but "We did not really have any objective at first, but if the family of any other Osram staff who died in similar circumstances realise what has happened maybe they can follow the same path.

"I don’t really feel angry, but when I look back at how quickly he went I feel like there were some years of his life that have been taken away.

The writ has been served and now we are waiting for a timetable of events, but expect it to go to trial in May or June." She said it depends on how much was released into the air and how much was inhaled.

"The problem is that it’s hard to determine what the health risks are," she said.

Once asbestos fibers are lodged in the lungs, they’re there to stay.

A chest X-ray can detect early signs of the lung diseases caused by asbestos, according to the EPA.

DLC Management won land development approvals in 2002 to build a mall on the former site of the 1950s-era Levittown Shopping Center.

Only three of the site’s 31 possible stores have been constructed.

Last year, the borough council voted to give Ifshin a two-year extension on his development agreement, a deal that will run out in early 2008.

In a meeting with Galloway on March 2, Ifshin told the state lawmaker he would meet with him again within 30 days with a "major announcement" regarding the future of the shopping center.

That date has since passed.

Last week, Beth Pirolli, president of the borough council, said she was "pretty confident" the shopping center would be completed.

Pirolli preferred not to comment Tuesday night because she was not fully informed of issue.

Also last week, Czyzyk said if Ifshin did not meet his June 2008 deadline for the shopping center, the council should consider taking the property through eminent domain.
